H1-B Visa Cap

Effective October 2003,  the previous cap of 195,000 for H1-B visas per fiscal year was reduced to 65,000.  What that means for you,  if this is your first H1-B visa petition, is that you need to file as soon as possible since the cap could be reached by mid fiscal year in February/March 2004.  It is definitely recommended that "Premium Processing" to expedite the case (extra $1000 fee) may therefore be the best way to go, especially as the cap cutoff date approaches. This cap applies ONLY to new employment H1-B petitions and does not affect renewals of existing H visas whether they be for the same or a new employer.  The cap is therefore not an issue for individuals already here in H Visa status. Hopefully if the economy improves and there is a shortage of workers in any field for which the H1-B is appropriate, the numbers will again be increased by Congress.  The fate of the US economy depends on having the best talent worldwide available to ensure that our economy prospers and grows.
